Macrometer Terms of Service

Effective date: October 25, 2026

These terms (the app calls them the Terms of Use) are an agreement between you and Tauren James Brown, an individual developer in California ("I", "me", "we", "us"), about the Macrometer iPhone app, the servers behind it, our legal pages and related services (together, "Macrometer" or the "service"). You accept these terms by tapping Agree and continue when you first open the app (the app asks again when the terms change) and by using Macrometer. If you don't agree, don't use the app. The Privacy Policy and the Consumer Health Data Privacy Policy describe how we handle information; they aren't part of this agreement, and where they say we ask for your consent, the app asks you separately.

Macrometer is distributed through Apple's App Store under Apple's Licensed Application End User License Agreement (the "Standard EULA"). The Standard EULA governs your license to the app itself; these terms add to it and cover the services, your content and how you treat other people. If the two conflict about the app license, the Standard EULA wins.

Please read sections 3, 11, 12, 16, 17, 18 and 19 carefully. They cover health risks, meeting other users, Ringo, disclaimers, limits on our liability, your agreement to cover certain claims, and how disputes are handled.

1. You must be 18 or older

Macrometer is for adults. You must be at least 18 years old to use it, including to create an account, send snaps or messages, or join a gym. Before anything else, the app asks your age: on iOS 26 and later it asks for the age range on your Apple Account (Apple's Declared Age Range) if you share it, and otherwise for your birth month and year. The answer stays on your iPhone. Under 18 gets a stop screen. By continuing past that screen you confirm you are 18 or older, that you can form a binding contract, and that you aren't barred from using the service under any law. If we learn or reasonably believe that an account belongs to someone under 18, we will delete it.

2. Not medical advice

Macrometer helps you keep track of food and estimate nutrition. It isn't a medical device and doesn't give medical, dietary or nutritional advice, diagnosis or treatment. Macrometer isn't designed to store medical records or to diagnose, treat or manage any medical condition, and we don't ask for diagnoses, medications or other medical history; if you choose to mention them in a ramble, message or Ringo chat, they're handled like any other content under the Privacy Policy. Calorie and macro targets, estimates, nutrient details, streaks, balance checks and anything Ringo says are general information generated by software, not a plan for you, and may not suit your situation. Ringo is an AI bot, not a dietitian, doctor, trainer or counselor. Nothing in Macrometer creates a professional relationship with us or replaces one with a qualified professional. Talk to a doctor or registered dietitian before changing your diet or exercise, especially if you're pregnant or breastfeeding, have a medical condition, take medication, or have a history of disordered eating. If you're struggling with food, body image or anything else, in the US you can call or text 988 (Suicide & Crisis Lifeline) any time, or text NEDA to 741741 for eating-disorder support; if you're in danger, call 911. Don't use Macrometer for emergencies.

3. You take on the risks of diet and exercise

Changing what you eat, restricting calories, fasting, exercising and going to a gym carry risks, including injury, illness, nutritional deficiency and, in some cases, serious harm. You decide whether and how to use the information Macrometer gives you, and you do so at your own risk. You confirm that you are in a condition to make those decisions, that you'll seek professional advice where it's appropriate, and that you accept full responsibility for the results of your diet, exercise and health choices, including any decision based on an estimate, target, streak, game, duel, status or Ringo reply. To the fullest extent the law allows, you release us from claims arising from those choices, including claims based on our ordinary negligence in making estimates, targets, balance checks, games or Ringo available. Section 17's "Limits on these limits" applies to this release.

4. Estimates can be wrong

Ramble and photo estimates, nutrient details, status ideas, the 50-50 game and Ringo's replies are made by AI models (currently Anthropic's Claude) and public food databases. They can mistake foods, portions, ingredients, allergens and nutrition, sometimes by a lot, and can be wrong, incomplete, out of date or inappropriate in other ways. AI output can also be inconsistent from one request to the next. Restaurant nutrition comes from what the chain has published, as found by the model, and may be out of date or mismatched. Don't rely on Macrometer to detect allergens, ingredients or anything that matters to your safety. Check the numbers and edit them when they're off. You're responsible for what you log and for decisions you make with it.

5. Your account

You sign in with Apple. Keep your Apple ID secure. You're responsible for what happens under your account until you tell us at admin@sl3.org that it's been misused, except to the extent the misuse was caused by a failure of our own security. One account per person, for your own personal, non-commercial use. Don't share, sell or transfer your account. You can sign out or delete your account at any time in Friends (the … menu next to "Signed in as"). Deleting removes your account and its data from our live systems as the Privacy Policy describes.

6. Your content

"Your content" is what you put into Macrometer: foods, Ramble words, meal photos and depth readings, snaps and selfies, messages, statuses, your name and emoji, crew and pet names, duel stakes, reports, and anything else you create, upload or send through the service.

7. Our content and rights

Macrometer, including its name, logo, Ringo and its personality, the app's designs, text, graphics, software, databases (including the shared menu cache) and everything else we provide, belong to us or our licensors and are protected by copyright, trademark and other laws. Apart from the license to use the app under the Standard EULA and the rights these terms grant, we reserve all rights. Don't copy, modify, distribute, sell, lease, reverse-engineer, scrape or build on any part of the service except as the law expressly allows. Nutrition data from public databases belongs to its sources. Content from other users belongs to them.

8. Rules: no objectionable content, no abuse

Macrometer is a small, friendly place, and we intend to keep it that way. Objectionable content and abusive behavior aren't allowed, and we remove them when they're reported or we find them. Don't post, send or do any of the following:

If you break these rules, or we reasonably believe you have, we may remove or hide the content, warn you, limit features, and suspend or delete your account, with or without notice. Someone we remove can't sign back in with the same Apple ID. We may also report illegal content or activity to the authorities and cooperate with investigations.

Report and block

Reports are reviewed by a person. We aim to review them promptly and to remove content and accounts that break these rules, but we can't promise a particular response time or outcome, and we decide reports in our reasonable discretion. We may tell the person who reported that we've acted, without details.

9. Friends, crews, gyms and what others see

Friends, crewmates and people at your gym see what the Privacy Policy, section 6, says they see. Friends and crewmates see your first name and emoji, whether you logged, your streaks, your status, and the snaps and messages you choose to send them; people at your gym see your first name and emoji, your current streak and whether you logged today. The app doesn't show any of them your food, calories or weight. Anyone with your invite code can become your friend, so share codes only with people you want as friends. Joining a gym lists you to everyone else who joined that gym, and a gym listing or check-in shows that you were at that place. What you see comes only from people you've connected with, newest first; we don't recommend content or people to you based on a profile of you.

10. Games, streaks and duels

Streaks, crew XP, quests, the crew trail, snap pets, the 50-50 game, Over/Under, food fights and duels are for fun. They have no cash value, can't be bought, sold or redeemed, and we may change, reset, re-balance or remove them at any time without liability. Macrometer has no in-app purchases and doesn't hold, pay or collect stakes or prizes.

A duel's stakes are a note between you and your friend, written in your own words, up to 60 characters. Macrometer doesn't enforce them and isn't a party to them. Don't use stakes for money bets, anything of value, or anything illegal where you live, and keep them within section 8. Any arrangement between you and another user about stakes is your own, and we aren't responsible for it.

Games are designed so that what you eat doesn't change their outcome; logging honestly isn't meant to cost you anything in a game.

11. Other users, and meeting people from your gym

Macrometer connects you with people you invite, people in your crew, and people who say they go to the same gym. We don't verify anyone's identity, age, location, fitness, intentions or background, and we don't run background checks. We aren't responsible for the conduct of any user, online or offline, or for content they send you. We're an interactive computer service under 47 U.S.C. §230 and aren't the publisher of what other users post or send.

If you choose to meet, train with, or otherwise interact in person with someone you met through Macrometer, you do so entirely at your own risk. Use your judgment, meet in public places, and tell someone where you're going. To the fullest extent the law allows, you release us from any claim arising from the content or conduct of other users, online or in person, including claims based on our ordinary negligence in moderating or failing to moderate. Section 17's "Limits on these limits" applies to this release.

Release. For disputes between you and other users, you release us (and anyone who takes over Macrometer) from claims, demands and damages of every kind, known and unknown, arising out of or connected with those disputes. If you're a California resident, you waive California Civil Code §1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." This waiver covers only claims about other users' content and conduct, and only to the extent section 17's "Limits on these limits" allows.

12. Ringo and AI

Ringo is an AI bot powered by a large language model (currently Anthropic's Claude). Its replies are generated, can be wrong, inconsistent, out of character, hurtful or inappropriate, and are not advice. Ringo has a playful, teasing personality; if that isn't for you, you don't have to chat with it. Chatting with Ringo needs AI features on (asked when you first open the app; Me → Privacy & terms), because what you send it goes to Anthropic for the reply, as the Privacy Policy describes. With Let Ringo see your log and rambles on, your recent log and rambles are sent to our AI provider for each reply; it's off until you turn it on. Don't rely on Ringo in an emergency, and don't tell it anything you wouldn't want stored as a chat message. If Ringo says something wrong or hurtful, long-press the message and report it. We may change the model behind Ringo and the estimate features at any time.

Ringo safety. Ringo is artificially generated and not human. Its chat shows a line that stays in view saying so and giving the 988 line, Ringo will say it's an AI if you ask, and it's instructed never to claim to be human or to be a doctor, dietitian, nutritionist, therapist or any other health professional; it isn't licensed in anything. Ringo isn't built to talk you through a crisis. If what you send it contains plain words about suicide, self-harm or an eating-disorder crisis, our server doesn't ask the AI and Ringo answers with a fixed message giving 988, the NEDA text line (text NEDA to 741741) and 911. For anything subtler, Ringo is instructed to drop the jokes and point you to 988, and never to suggest eating less, skipping meals, fasting or "earning" food, or to comment on your body, weight or looks; instructions to an AI can fail, which is one reason Ringo isn't a substitute for a person. How this works is described in our published crisis protocol. We count how often Ringo shows the crisis message (the count only, not what you said or who you are) so we can report it to the California Office of Suicide Prevention as California law requires. Companion chatbots may not be suitable for some minors; Macrometer is for adults 18 and over.

13. Third-party services

Macrometer uses services run by others, currently Anthropic (AI models and web search), ElevenLabs (speech to text), Cloudflare (hosting, storage and notification relay), Apple (the App Store, Sign in with Apple, push notifications, speech recognition, the Declared Age Range check and Apple Maps), and Open Food Facts and USDA FoodData Central (public food databases). Their own terms apply to their services, and we may change providers. We aren't responsible for third-party services or for content from them. Nutrition from public databases is provided by them and may be incomplete or wrong. Gym listings come from Apple Maps and may be wrong or out of date.

14. Changes, availability and beta features

We may change, suspend, limit or stop any part of Macrometer (including AI estimates, Ringo and the social features) at any time, for any reason, with or without notice, and we aren't liable to you for doing so. The service may be unavailable now and then, and data may be lost; keep your own records of anything that matters to you. Features labeled beta, preview or "soon", and AI features in general, may not work well.

We may update these terms. When we do, we'll post the new version at this address with a new effective date. A material change applies to you once you accept it in the app, which asks you to agree again when the terms change, or, if you don't open the app, after we've posted it and given notice in the app or in another reasonable way; a change that only fixes wording, describes a feature or is required by law applies when posted. Changes don't apply to a dispute that arose before they took effect. If you don't agree to a change, stop using the app and delete your account.

15. Termination

You can stop using Macrometer at any time by deleting your account and the app. We may suspend, limit or end your access to all or part of Macrometer at any time, for any reason or no reason, with or without notice, including if we believe you've broken these terms, created risk or legal exposure for us or others, or if we stop offering the service. On termination, your right to use the service ends and we may delete your account and content, though we may keep what the Privacy Policy says we keep. Sections 2, 3, 4, 6 (for content already shared and the feedback license), 7, 11, 16 through 20 and 22 survive termination.

16. Disclaimers

To the fullest extent permitted by law, Macrometer and everything in it, including estimates, nutrition information, targets, AI output, games, user content and third-party content, are provided "as is", "with all faults" and "as available", without warranties or conditions of any kind, express, implied or statutory, including any warranty of accuracy, completeness, reliability, timeliness, merchantability, fitness for a particular purpose, quiet enjoyment, title or non-infringement, and any warranty arising from course of dealing or usage of trade. We don't warrant that the service will be uninterrupted, secure, error-free or free of harmful components, that defects will be corrected, that it will meet your needs or produce any particular result, or that any content is accurate. Any advice or information you get from us, from Ringo or from other users doesn't create a warranty. You use Macrometer at your own risk. Content from other users is theirs, not ours, and we don't endorse it. Some places don't allow some of these disclaimers, so some may not apply to you.

17. Limitation of liability

To the fullest extent permitted by law, we (and anyone who takes over Macrometer) will not be liable to you for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, revenue, goodwill or opportunity, or the cost of substitute services, arising out of or related to Macrometer, these terms, your content, AI output, other users' content or conduct (online or in person), third-party services, or unauthorized access to your data, whether in contract, tort (including negligence), strict liability or any other theory, even if we've been told such damages were possible.

To the fullest extent permitted by law, our total liability to you for all claims arising out of or related to Macrometer or these terms, taken together, is limited to the greater of (a) US $50 and (b) the amount you paid us for Macrometer in the 12 months before the claim. This cap applies to claims for personal injury, emotional distress and health or fitness outcomes as well, to the extent the law allows, except as the next paragraph says.

These limits apply to everything these terms cover and are a basic part of the bargain between you and us; Macrometer is offered as a small, low-cost service and wouldn't be offered without them. Some places don't allow some of these limits, so they may not apply to you.

Limits on these limits. Nothing in sections 3, 11, 16, 17 or 18 limits or releases liability that California law says can't be limited or released: fraud, willful injury to a person or property, gross negligence, violation of law whether willful or negligent (Cal. Civ. Code §1668), or rights under consumer protection and privacy statutes that can't be waived, including the California Consumers Legal Remedies Act and the California Consumer Privacy Act. Nothing in these terms limits the protection 47 U.S.C. §230 gives us. Where the law of your home state gives you more protection than this section allows us to take away, you keep it.

18. Indemnification

If someone other than you brings a claim against Tauren James Brown or anyone who takes over Macrometer because of (a) your content, (b) your breach of section 8 or of any law or anyone's rights, or (c) your interactions with other users, online or in person, including any duel stakes, you agree to cover the resulting losses, damages, liabilities, fines, costs and reasonable attorneys' fees, except to the extent the claim was caused by our own negligence, breach of these terms or willful misconduct. We may take over the defense of a matter you must cover, and you'll cooperate with us. This section doesn't apply to claims you bring yourself.

19. Disputes and governing law

These terms, and any dispute between you and us, are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules, and by US federal law where it applies. Before going to court, email admin@sl3.org describing the problem and what you want, and we'll try to sort it out informally within 60 days. If we can't, claims go to the state or federal courts located in California, and you and we consent to their personal jurisdiction and venue, unless the consumer law where you live gives you the right to sue at home. You may also bring a qualifying claim in small claims court. There's no arbitration clause: you keep your right to go to court.

To the extent the law allows, any claim either of us brings against the other arising out of Macrometer or these terms must be filed within one year after the day the claim arose or the day the party knew or reasonably should have known of it, whichever is later, or it is barred. This doesn't shorten the time for any claim whose limitations period the law says can't be shortened by agreement. Each party may seek injunctive or other equitable relief in court to protect its rights, including its intellectual property or the security of the service.

20. Apple

These terms are between you and Tauren James Brown, not Apple, and Apple isn't responsible for Macrometer or its content. Apple has no obligation to provide maintenance or support for Macrometer. If Macrometer fails to conform to a warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. We, not Apple, handle any claims about Macrometer, including product liability, legal or regulatory compliance and consumer protection claims, and any claim that it infringes someone's intellectual property. You confirm you're not in a country under a US government embargo or designated a "terrorist supporting" country, and that you aren't on a US government list of prohibited or restricted parties. You agree to comply with applicable third-party terms (for example, your wireless carrier's). Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Questions, complaints or claims: admin@sl3.org.
